In New Jersey, a worker injured on the job is entitled to 70% of their gross weekly wages while recovering from their injury, up to a maximum of $666 per week. Payments begin on the 8th day of missed work. The injured worker is entitled to medical treatment to cure their injury, but their employer and the employers insurance company have the right to choose the doctor from which the injured worker will receive treatment. For an injury resulting in permanent disability, payments will be for an initial period of 450 weeks (c. 9 years), and then be re-evaluated and continued if still the injured worker is still disabled. The Workers' Comp system is a no-fault system that seeks to strike a balance that is fair to both the injured worker and the employer when a worker is injured on the job. Under the Workers Comp system, an employee injured on the job cannot sue their employer for negligence, and is not eligible for a pain and suffering award. The injured worker is limited to the benefits available to them under the Workmans Compensation system. Employers have to pay insurance premiums on their required Workers Compensation insurance, but will not have to face a million dollar pain and suffering judgment. The employers Workmans Comp insurance, and not the employees own individual health insurance, pays the claim.
